Marine's compensation case adjourned

A Royal Marine who lost two limbs in a mine explosion in Afghanistan has had his compensation appeal hearing adjourned.

Ben McBean, 22, from Plymouth, was serving with Taunton-based 40 Commando, in Afghanistan in February 2008 when he lost an arm and a leg in the roadside blast.

Described by Prince Harry as a "real hero", the marine was awarded £281,150 and a pension by the Ministry of Defence (MoD). He had initially been awarded £161,500 in June 2008 but following a change in the system in December this increased.

However, he is appealing the amount as the extent of his injuries was not taken into account.

In order for the other claims, which are in respect to groin injuries and insomnia, to be taken into account the case has been adjourned.

Marine McBean is also expected to argue that compensation claims for wounded personnel should be taken as a whole and not in stages as separate claims.

Under the current scheme, lump sum payments for the most serious injuries are capped at £570,000, but this is being reviewed by the Government.
